Wills

A will is a document that is created to explictly state what you wish to happen to your estate upon your passing.  That is, who gets what.  By stating which of your beneficiaries are to receive which portions of your estate through a will, the argument over assets may be minimized.  The creating of a will or living will is important to protect your wishes and estate.  The actual distribution of your assets is controlled by the legal process called PROBATE. 

Trusts

A living trust avoids probate because your property is owned by the trust.  There is nothing for probate courts to administer.  Whomever you name as your "successor trustee" gains control of your assets and distribute them exactly according to your instructions.  A living trust can help you preserve and increase your estate while you are alive, and offers protection should you become mentally disabled.
